Mark has acted as legal counsel, before all levels of court, on a wide variety of cases including human rights disputes and cases, construction deficiency litigation, professional negligence, real estate litigation, occupiers liability,  enforcement matters of every stripe and variety, directors' liability, employment law, breach of contract disputes, personal injury, and human rights issues. Mark's background includes instructing in the area of Civil Trial Practice for the Law Society of Upper Canada in its annual Bar Admission Course.

Prior to becoming a lawyer, Mark was a college teacher in Montreal, Charlottetown and Halifax. Mark was the first Executive Director for the Prince Edward Island Human Rights Commission. He worked for CBC Radio in Charlottetown as a freelance broadcaster and storyteller.

Mark is an avid sportsman. He and his family spend the summer months cycling back roads and rafting and kayaking the lakes and rivers of Ontario, Quebec and British Columbia. During the winter months, Mark enjoys jogging in Toronto when the weather permits, and crosstraining on his indoor cycling trainer.

Mark takes advantage of the cultural diversity of Toronto and the GTA by learning new cooking techniques from around the world, with a special focus on Judæo-Asian cooking, with a splash of mango chutney.

Mark was a member of the Canadian National Track and Field Team during his student days, competed for Canada in the Pan American Games and ranked as one of the top three sprinters in Canada.

Certified Specialist


The Certified Specialist Program recognizes members of the Law Society who have met established standards of experience and knowledge requirements in one or more designated areas of law and have maintained exemplary standards of professional practice.

Qualifications for Certification

To be Certified as a Specialist, a lawyer must have:

  • practiced for a minimum of seven years prior to the date of the application.

  • had substantial involvement in the specialty area during five of the seven years,

    • mastery of substantive law, practices and procedures, and

    • concentration of practice in the specialty area;

  • complied with the professional development requirements; and

  • complied with the professional standards requirements.

The stringent qualifications as set out above, by the Law Society of Upper Canada, ensure that anyone Certified as a Specialist is not only highly experienced, but has attained and maintained a high level of legal education.

MEIDATION AND ARBITRATION (ADR)

Under the Ontario Rules of Civil Procedure and the Condominium Act, 1998, mediation is mandatory.

Mediation is a dispute resolution procedure that permits parties to a lawsuit to hammer out a resolution of their issues in a way that is mutually beneficial. A mediator facilitates and presides over the mediation session and has special skills to assist the parties in resolving their dispute. Proper preparation for mediation includes having a thorough grasp of the case and choosing a mediator most suited to assist in resolving the dispute.

Mark has acted for clients in a wide variety of successful mediation sessions. Mark is a senior advocate with experience handling a vast array of cases, clients and mediators. Mark's expertise as an advocate and his ability to adapt his approach to the specific needs of the case and the parties makes him ideally suite as mediation counsel.

What is a good mediator?

The answer is subjective. Based on Mark's experience, a good mediator must possess effective analytical ability and be able to quickly and accurately evaluate the core issues. While this may be somewhat unorthodox, in Mark's experience, to be effective, a mediator must have a solid understanding of the issues, be they legal or emotional.

A mediator must be respectful of the parties and their positions. A mediator must appreciate the different personalities at the table, and determine the depth and extent of the emotional overlay that exists. A mediator must be aware and understand mediation is also cathartic.

A mediator must understand complex areas of law and issues. That means the mediator must know the applicable law in depth and be able to quickly evaluate the range of applicable damages. A mediator must also fully understand both the litigation process and how mediation adds value. Mark has all of these qualities, plus a little humour, patience, tolerance and humility to bring to his mediation practice.
