A major focus of his practice over the past 30+ years is Condominium Law. Mark dedicates his practice to early resolution on a "live and let live" philosophy. Some disputes arise because the parties do not understand the benefits and burdens of condominium living. Owners/tenants may not fully understand that they do not control the common elements which surround their unit living space. Condominium boards are often advised by their lawyers to strictly enforce condominium law without compromise. Mark has represented both unit owners and condominium boards. He has resolved numerous condominium disputes. He is knowledgeable, sensitive, compassionate and approachable. He firmly believes that disputes between the board, unit owners and tenants are to be avoided or quickly settled.

Condominiums are similar to small villages. A condominium unit owner enjoys ownership rights over their unit with an obligation to contribute maintenance expense fees for the common element portions of the condominium complex.

A condominium board elected by unit owners is obligated to manage and administer the common elements; everything in the community outside of the boundaries of the individual units. Common elements include hallways, elevators, roof, basement, furnace and air conditioning.

Condominium unit ownership provides an excellent opportunity for the unit owner to build wealth and as well as providing a reasonable and supported place to live. Some condominium unit owners choose not to live in their unit preferring to rent it out.

Frequently, condominium unit owners and tenants run afoul of the condominium board because of a failure to understand the important legal relationship and obligation between the condominium corporation and the unit owner/tenant. Ultimately unit owners are responsible for the conduct of their tenants.

In the face of disputes between unit owner/tenants and the condominium board the law requires mediation as the first-line resolution; an opportunity to bring the dispute before a trained mediator for a consensual resolution. Most condominium disputes are resolved at mediation. Disputes that cannot be resolved are subject to arbitration. An arbitrator is a private judge chosen by the parties mandated to fairly and equitably hear the dispute and make a binding decision.

Some disputes are resolved or decided by the Condominium Authority Tribunal, an administrative body appointed by the government designed to be a quick and efficient resolution procedure.
